Colorado doesn’t use the term ‘custody’ in its statutes — it uses Allocation of Parental Responsibilities, or APR. The distinction isn’t just semantic. APR separates two distinct issues: decision-making authority (who has the legal right to make major decisions about the child’s education, healthcare, and religious upbringing) and parenting time (where the child physically lives and on what schedule). Both are determined separately and can be allocated in different ways depending on what serves the child best.
All APR decisions in Boulder County are made under a best-interests-of-the-child standard. Colorado courts weigh a range of factors including each parent’s relationship with the child, the child’s adjustment to home, school, and community, each parent’s ability to support the child’s relationship with the other parent, and any history of abuse or neglect.
