  • Class 1 Felony: Life in prison.
  • Class 2 Felony: 8 to 24 years in prison, fine of $5,000 to $1,000,000
  • Class 3 Felony: 4 to 12 years in prison, fine of $3,000 to $750,000
  • Class 4 Felony: 2 to 6 years in prison, fine of $2,000 to $500,000
  • Class 5 Felony :1 to 3 years in prison, fine of $1,000 to $100,000
  • Class 6 Felony: 12 to 18 months in prison, fine of $1,000 to $100,000

The presumptive range of prison can be increased if there are certain “aggravating factors,” or if the offense is classified as an “extraordinary risk crime.” Some aggravating factors are when a weapon is used during the crime, when the defendant was on probation/parole at the time the offense was committed, and when the defendant has previous convictions. Some extraordinary risk crimes are certain child abuse crimes, crimes of violence, and certain drug offenses involving manufacturing or trafficking.
